USDOT Proposes Adding Fentanyl to Existing Truck Driver Drug Testing Program
The U.S. Department of Transportation (USDOT) has published a proposed rule to expand the list of drugs tested in its mandatory testing program for safety-sensitive transportation employees. The update would add both fentanyl and its primary metabolite, norfentanyl, to the panel of tested substances.
The proposed rule was issued on September 2, 2025, and is currently open for public comment through October 17, 2025.
Currently, under 49 CFR Part 40 Subpart F, USDOT requires drug testing for marijuana, cocaine, opiates, amphetamines and methamphetamines, and phencyclidine (PCP). The inclusion of fentanyl and norfentanyl would bring the DOT program into closer alignment with updated guidelines from the U.S. Department of Health and Human Services (HHS).
USDOT cited alarming statistics showing approximately 150 overdose deaths per day in the U.S. from synthetic opioids, primarily fentanyl. The agency believes this change is necessary to enhance safety in transportation sectors such as trucking, aviation, rail, and transit.
What the Proposed Rule Includes
The proposed amendment would:
Add fentanyl and norfentanyl to the list of tested substances.
Align DOT testing protocols with HHS Mandatory Guidelines.
Incorporate updated terminology and definitions.
Clarify existing procedures related to drug testing and specimen handling.
These changes would support the implementation of the Omnibus Employee Testing Act of 1991, which requires the use of HHS standards for drug testing among federally regulated workers.
Implications for Trucking and Transportation Employers
If adopted, employers will need to ensure that their drug testing protocols are updated to reflect these changes. Testing providers would also be required to implement the updated panels in compliance with DOT standards.
